Deadline for Cosmetic Product Manufacturers to Comply with New Federal Regulations Quickly Approaching

06/18/2024

A new deadline is quickly approaching for cosmetic product manufacturers to comply with federal regulations.

Cosmetic products companies are required to register facilities, list products and report serious adverse events by July 1. The companies must also develop and maintain safety substantiation records and follow good manufacturing practice regulations.

The new registration and listing requirements fall under the Modernization of Cosmetics Regulation Act of 2022 (MoCRA). The new law was historic in the event of cosmetics in the United States and most significant expansion of the US Food and Drug Administration’s (FDA) authority to regulate cosmetics since the Federal Food, Drug, and Cosmetic Act in 1938, according to Wiley.law

Cosmetic product facilities are required to register with the FDA and renew their registration every two years. Wiley.law says a cosmetic product facility is any establishment that manufacturers or processes cosmetic products distributed in the US. Salons, retailers, healthcare-related facilities are not considered cosmetic product facilities and will not have to comply with the regulations.
